Acceptable Use Policy

Private AI Inc.’s (“we”, “our”, or “PAI”) mission is to build the privacy layer for software. Our team strives for product perfection, while building a culture imbued with generosity, continuous teaching, learning and feedback, and celebrations of each others’ successes. This Acceptable Use Policy (as amended, restated, modified, supplemented, or replaced from time to time by PAI, collectively, the “AUP”) is designed to help foster that culture; it describes activities that are prohibited in connection with the use of PAI’s technology and services (including, inter alia, PAI’s hosted platform available https://www.private-ai.com/ and any associated websites, products or services offered by PAI from time to time, collectively, the “Services”).

You (“you”, “your”, or the “Client”) are solely responsible for ensuring compliance with all applicable laws, including, but not limited to, the General Data Protection Regulation (GDPR), with respect to your provision and end users’ use of the Services. In addition, neither Client, nor those that access the Services through Client, may use the Services:

1. in a way prohibited by law, regulation, governmental order or decree;
2. to violate the rights of others including, inter alia, any third-party or in connection with any Third-Party Products;
3. in a way that exceeds any usage terms (including, without limitation, any use or other applicable rate limits);
4. to try to gain unauthorized access to or disrupt any service, device, data, account or network, including by intentionally evading or disrupting restrictions;
5. to spam or distribute malware;
6. in a way that could harm Private AI or the Service (including, without limitation, impairing anyone else’s use of it); or;
7. to assist or encourage anyone to do any of the above.

Fraudulent or other unacceptable behaviour by or through you, including breach of this AUP, as determined by PAI in its sole discretion, may result in one or more of the following actions being taken by PAI: (a) termination or suspension of Services including by or through any user account(s); (b) suspension of some or all functionality of the Services; and (c) termination of any user account(s) entirely without notice to, or recourse for, Client. The remedies hereunder are without limitation to any of PAI’s other remedies that may be available to it at law or in equity. If PAI suspends the Service, PAI will suspend only to the extent reasonably necessary. Unless PAI believes an immediate suspension is required, PAI will provide reasonable notice before suspending the Service or any part thereof for the reasons stated above.

We may, at any time and without notice, suspend or terminate your user account(s) or your access to the Services if you engage in activities that violate the letter or spirit of this AUP, including activities outside of your use of the Services.

PAI has the right, but not the obligation, to monitor or investigate your use of the Services at any time for compliance with this AUP and the Terms of Service available here https://private-ai.com/terms, or any other agreement between you and PAI governing your use of the Services (collectively, the “Terms”). PAI’s determination of whether a violation of this AUP has occurred will be final and binding, and any action taken with respect to enforcing this AUP, including taking no action at all, will be at our sole discretion.

PAI may modify this AUP, at any time by posting a revised version at https://private-ai.com/aup. By continuing to use the Services or access your user account(s) after a revised version of the AUP has been posted, you agree to comply with the latest version of the AUP. In the event of a conflict between the AUP and the Terms, this AUP will take precedence, but only to the extent required to resolve such conflict. Capitalized terms used but not defined in this AUP shall have the meanings set forth in the Terms.
